Legal Justification
The PCR 2015 (Regulation 32(5)(b) of the PCR) provides for the ground for the provision of additional requirements (deliveries) by the original supplier, which are an extension of installations where a change of supplier would require the authority to acquire supplies with different characteristics resulting in incompatibility or disproportionate technical and maintenance difficulties. Through the application of the following tests, it is evident that the introduction of another Nurse Call System at Dorset County Hospital meets this criteria: 1. Other systems would have different technical characteristics.2. Other systems would result in incompatibility and disproportionate technical difficulties in operation and maintenance.3. This is a supply contract- This contact is supply only. It is however evident that if the Trust were to proceed with supply and install, the installation element is incidental to the supply as the system will not function without installation and therefore the requirement will always be treated as a supply contract.4. This supply contract does not exceed a 3 year period.
