Description
The nature of this pandemic and the pace of the interventions required has led the Council to develop a hub and spoke model across Birmingham for delivery of rapid result testing in a targeted and scaled way to contain the spread of the virus and reduce transmission in higher risk population groups. The aim of this critical service is to capture data about levels of asymptomatic infection in target areas of Birmingham to reduce infection rates and particularly avoid further spread to vulnerable citizens who may develop a serious infection. This contract will specifically enable Royal Mail Group Limited to test their Birmingham based employees throughout their operational shift patterns.

Legal Justification
Birmingham City Council has activated its Business Continuity and Emergency Plans in response to the Coronavirus outbreak by applying Regulation 32(2)(b)(ii) under the Public Contract Regulations 2015 in response to the Coronavirus outbreak in order to support the urgent issuing of lateral flow device testing kits to the service provider. This urgent award enables a contract to be executed to carry out the Council's Public Health duty and avoid further spread of COVID-19 in the local population. Explanation: Under 32(2) The negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases:- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons:- (ii) competition is absent for technical reasons, but only, in the case of paragraphs (ii) and (iii), where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
