Legal Justification
The CMA's requirement involved the necessity to use specific know-how, technical expertise and experience for the purposes of expert input, and potential expert witness services, which only one economic operator has at its disposal; and no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement. The CMA may therefore use the negotiated procedure without prior publication in accordance with Regulation 32(2)(b)(ii) of the Public Contract Regulations 2015.
