Description

NHS England and NHS Improvement South East (the Commissioner) seeks to commission a Mental Health Treatment Requirements (MHTRs) Service across the South East. This forms part of the wider Community Sentence Treatment Requirements (CSTRs) Programme which is a partnership between the Ministry of Justice (MoJ), Department of Health and Social Care (DHSC), NHS England and NHS Improvement (NHSE/I), Public Health England (PHE) and Her Majesty's Prison and Probation Service (HMPPS).

Total Quantity or Scope

This notice is placed as a Prior Information Notice in order to facilitate engagement with potential providers, and relates only to pre-procurement market engagement. The CSTR Programme aims to develop pathways to enable and facilitate the increased use of all three treatment requirements: - Mental Health Treatment Requirements (MHTRs) - Drug Rehabilitation Requirements (DRRs) - Alcohol Treatment Requirements (ATRs) For this commissioning exercise, MHTRs will be in scope, and DRRs and ATRs out of scope. The key aims of the CSTR Programme are to: • Reduce offending/re-offending • Provide alternatives to short custodial sentences for offenders • Improve health and social care outcomes • Provide accessible services which enable engagement • Strive for sentencing on the day where possible • Enable access to statutory community services • Ensure consistency of service provision within all new and existing CSTR sites Following the success of five testbed sites in Birmingham, Milton Keynes, Northampton, Sefton and Plymouth set up in 2017/2018, the view is to increase the use of CSTRs. For this commissioning exercise, MHTRs will be the sole treatment requirement delivered operationally. The precise scope is to be confirmed, but is likely to include: - Reading Magistrates Court - Southampton / Winchester Magistrates Court - Guildford Magistrates Court - Lewes Magistrates Court - Oxford Combined Court - Maidstone Combined Court Consideration is being given to the potential lotting strategy, with the outcomes of market engagement being used to inform the final decision. It is anticipated that the contracts will commence in Summer / Autumn 2022, with the possibility of the Reading Court having an earlier commencement date of Spring 2022. The contract term will be for a fixed term of 3 years with no extension option. It is therefore anticipated that the procurement exercise(s) will be undertaken and commenced late 2021 / early 2022. At this stage, Commissioners would like to determine the level of provider interest from all sectors (including voluntary and third sector) in this opportunity and seeks responses to a market engagement questionnaire, the aim of which is to obtain feedback from the market to help inform re-commissioning. Please complete this online questionnaire and return it by 12 noon, Monday 27th September 2021. This Service will likely be commissioned using the CSTR National Operating Framework and MHTR Service Description. Both have been made available within the e-procurement system In-Tend. Some local tailoring may be made to these documents for this contract, and published as part of the final procurement documentation. The ATR and DRR Service Description, and Secondary Care MHTR Requirements have also been made available, however, these are for background information purposes only as both of these requirements fall out of the scope of this commissioning exercise. This exercise is being carried out by NHS South, Central & West Commissioning Support Unit (SCW) on behalf of the Commissioner. This notice is an information gathering exercise rather than a call for competition in its own right, and therefore publication or response does not commit NHSE/I or respondents to a future procurement, nor provide any process exemptions or preferential treatment to any parties expressing an interest. NHSE/I will not be liable for costs incurred by any interested party in participating in this exercise. The services are healthcare services falling within Schedule 3 to the Public Contracts Regulations 2015 ("the Regulations") which are not subject to the full regime of the Regulations, but is instead governed by the "Light Touch Regime" contained within Chapter 3, Section 7 of the Regulations (Regulations 74 to 77).
