Description
Corserv Ltd, on behalf of Cormac Solutions Ltd, a Cornwall Council wholly owned company has a mutually beneficial framework partnership with a single external service provider to provide the required range of engineering and technical related consultancy services. This contract is a ‘top-up’ services framework to support and provide additional capacity for in-house civil engineering and environmental design teams. The agreement commenced in April 2017 and terminated in March 2021. It is being extended until the 31st May 2022 for the reasons explained later in this notice.
Total Quantity or Scope
The appointed supplier will provide engineering and technical services to Cormac Solutions Ltd, Corserv Ltd including other joint and independent ventures, Cornwall Council or their successors in title, other Cornwall Council wholly owned companies, and other public sector organisations and bodies (see below) in Cornwall and the Isles of Scilly along with others, who may at a later date adopt the terms and conditions of this framework agreement. Whilst there is no guaranteed quantity or spend, the estimated value ordered through Cormac Solutions Ltd, Corserv Ltd, Cornwall Council and the group of wholly owned companies is likely to be in the region of 250 000 GBP to 3 000 000 GBP per annum. The potential estimated total value is likely to exceed this range if other organisations decide to participate. The services will be for the whole of Cormac Solutions Ltd, all directorates of Cornwall Council, plus Parish, Town and City Councils, and other public sector bodies (including Schools, Housing Associations / Housing Management Organisations, Police, NHS / Primary Care Truste etc.), who may at a later date adopt the terms and conditions of the framework agreement.

Legal Justification
Corserv Ltd believes that it can extend the Framework Agreement with the economic operator without prior publication of a contract notice for the following reasons: (A) Cormac and the Supplier are party to the Framework Agreement for the provision of Engineering and Technical Services dated 26 July 2017 with a Commencement Date of 1 April 2017 (the “Framework Agreement”). (B) The Term of the Agreement was for a period of four years from the Commencement Date, therefore terminating on 31 March 2021. (C) Due to the COVID-19 worldwide pandemic impacting Cormac’s certainty on its requirements for Engineering and Technical Services for 2021/22, Cormac and the Supplier entered into a Deed of Variation in December 2020 (the “Deed of Variation”) extending the Term of the Framework Agreement, for a period of 6 months, in accordance with Regulation 72(1)(c) of the Public Contracts Regulations 2015 with effect from 1 April 2021. (D) Following market testing, it is understood that the continuing impact of the COVID-19 pandemic has adversely impacted the current market with unprecedented high levels of work. As a result, it is understood and confirmed by market testing that suppliers are not in a position to effectively respond to any tender issued by Cormac relating to its engineering and technical services requirements. (E) The impact of COVID-19 has meant that there is a lack of clarity in respect of the specification, nature and extent of the work required from the prime commissioner of Cormac (Cornwall Council) through to the re-tender of this Framework. Without this clarity it could reasonably be foreseen to jeopardise the offer to the market and compromise the subsequent response, which will limit the longevity and use of the framework making it ineffective and lead to abortive costs (for the industry) in contravention of government guidance. (F) Accordingly, Cormac wishes to further extend the Term of the Framework Agreement until the 31 May 2022.
