Description
Defence Equipment and Support (DE&S), part of the UK Ministry of Defence (the Authority), proposes to place a single source contract with Ultra Electronic Ocean Systems (UEOS). This contract will be for the In-Service Support (ISS) of the current Submarine Countermeasure Acoustic Device (SCAD) systems. This contract is to be placed for the Contract term of 30 June 2022 up to 29 June 2024.

The contract is for the provision of in-service support. Activities will include but not be limited to: a) programme and contract management b) provision of remote support c) provision of technical advice d) provision of support on as required basis e) provision of training to ships staff and Torpedo loading Party f) provision of collection and disposal services g) other support related activities requiring site visits.

Legal Justification
Defence Equipment and Support Group (DE&S), part of the UK Ministry of Defence, proposes to place a contract with Ultra Electronic Ocean Systems (UEOS) to maintain the Submarine Countermeasure Acoustic support. Activities will include but not be limited to: a) programme and contract management b) provision of remote support c) provision of technical advice d) provision of support on as required basis e) provision of training to ships staff and Torpedo loading Party f) provision of collection and disposal services g) other support related activities requiring site visits. It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Regulation 16 (1) (a) (ii) of the Defence and Security Public Contracts Regulations 2011 due to technical reasons. This is because Ultra Electronic Ocean Systems (UEOS), as the OEM, designed, developed and supplied the SCAD countermeasure capability for use on A, T & V class submarines and has supported the capability since their introduction into service and is therefore the only supplier with the relevant knowledge inclusive of designs, drawings and technical data to support the SCAD countermeasures. The data is proprietary owned and is necessary for the fulfilment of the requirement, and therefore as no other contractor would have access to it, no other contractor could fulfil this requirement. Ensuring its continued interoperability with other elements of the UK Ministry of Defence’s submarine combat system (SAWCS & Sonar system, 2076 & 2054IR) all of which are essential for the protection of the Royal Navy submarines against torpedo attack which includes the Continuous at Sea Deterrent (CASD).
