Legal Justification
The International Guns, Missiles and Rockets Project Team, part of the UK Ministry of Defence (the Authority), intends to place a contract for the supply of spares for 20mm KAA Cannon & GAMB01 Mount. The estimated value of the contract is £1,863,000 and will be for a term of 4 years. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(a)(i) of the DSPCR 2011 because of the absence of suitable tenders. The Authority competed the requirement for the supply of spares for 20mm KAA cannon & GAMB01 Mount following the restricted procedure under the DSPCR (Tender 700177316 - 20mm KAA Cannon & GAMB01 Mount Spares). The Authority has received only one response to Tender 700177316 from Babcock International Group, Devonport Royal Dockyard , which was considered (without substantial changes) incapable of meeting the requirements specified in the procurement documents and therefore unsuitable. In accordance with regulation 16(1)(a)(i), in light of an absence of suitable tenders in response to the restricted procedure the Authority will use the negotiated procedure without prior publication of a contract notice to negotiate, on the basis that the original terms of the proposed contract offered in the restricted procedure are not substantially altered in the negotiated procedure.
