Legal Justification
Regulation 32 (2) of the Public Contracts Regulations permits the use of the Negotiated Procedure without prior publication when certain circumstances are met. One such circumstance is 32.—(1) In the specific cases and circumstances laid down in this regulation, contracting authorities may award public contracts by a negotiated procedure without prior publication. (2)(b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons:— (ii)competition is absent for technical reasons, Reason for award: Following a competitive tender process, the Smart Street Lighting contract was awarded to Amey OW Ltd. As part of the tender submission bidders were required to provide the luminaires they proposed to use on the contract which were scored in terms of whole life costs as part of the tender evaluation. The specification states that each luminaire type shall be obtained from one manufacturer and that all P Class luminaires must be from one manufacturer and all M Class luminaires must be from one manufacturer. Amey submitted their tender return with Signify as the luminaire manufacturer for all non-decorative luminaire types as they provided the lowest whole life costs giving the Council the most energy efficient solution. The majority of the works are being undertaken by Amey although there are elements of work that are deemed out of scope. This is work that the Council has retained control of to limit the risk to the council of escalating costs, for example the replacement of luminaires and lighting columns on back streets, in conservation areas and where the installations would be particularly challenging. Amey are responsible under the contract to undertake the lighting design for the project and have carried out the designs with Signify luminaires. If another manufacturers luminaires were to be used for the out of scope works this would incur additional costs for re-design and delay the completion of the project which would also reduce the energy savings which are a significant factor in the business case and also potentially affect the Salix interest free borrowing that is partially funding the project. The Council needs to purchase the luminaries for the out of scope work from Signify to ensure technical compatibility with the rest of the assets in the district and to minimise the number of different luminaires to be held in stock for future maintenance. Although it is permissible for the Council to purchase the Signify luminaires for the out of scope works through the Amey contract, this would incur additional costs in the form of handling charges etc. whereas purchasing direct from Signify provides better value for money.
