Legal Justification
The MCA are currently reviewing how it undertakes the assessments associated with UK Seafarers obtaining a UK Certificate of Competence (CoC). The current provision is conducted on a concessions basis with the MCA receiving a payment from the service provider to ensure that all costs associated with assistance and oversight of this service are fully recovered to mitigate against any burden on the UK taxpayer. SQA have previously been the delegated provider of the mandatory written examinations. This is an essential service and MCA needs to maintain continuity of service delivery whilst the review is conducted and taken forward. Seafarers are required to pass these examinations to obtain a CoC. The intention is to direct award this contract, establish the ongoing requirement and procure the necessary requirements following the review and identified recommendations. This recommendation is in accordance with Public Contracts Regulation (PCR) 2015 32(2)(b)(ii). SQA have been identified as the only suitable provider that can meet our need, within the scope of the current requirement, as they possess the specialised technical and industry expertise critical to maintaining the high standard of assessment for MCA cadets and seafarers. Their experience ensures that assessments align closely with the syllabus taught at MCA-approved maritime institutions.
