Legal Justification
The Merlin Delivery Team, part of the UK Ministry of Defence ("the Authority"), intends to place a 12 month contract with rolling 3 monthly extensions for up to a further 12 months as options, for the Interim In Service Support (Spares Availability, Technical Query Support and Repair Overhaul of Crowsnest Assets) to the Merlin Mk2 Crowsnest system to provide enhanced support to the initial RN deployment of Crowsnest and reflects the risks associated with the on going development activity of the Crowsnest Mission system. Lockheed Martin UK Ltd as the Co-Ordinating Design Organisation and Systems Integrator for the Merlin Mk2 are uniquely placed to manage the complexity of this requirement and its dependencies on the Lockheed Martin D M contract. The estimated value of the proposed contract is £7.9M (VAT Ex). It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1) (e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) on the basis that this contract may only be awarded to Lockheed Martin UK Ltd for technical reasons. Lockheed Martin UK Ltd, as the Merlin Mk2 Systems Integrator are the only economic operator with the detailed specific know how, tools and means to deliver the requirement particularly given consideration of the on going development activity that the Crowsnest D M contract, placed with Lockheed Martin UK Ltd. Furthermore, there is a requirement for the design organisation to be involved in providing as assured and continued airworthiness product for RN use prior to completion and delivery of the full Crowsnest capability.
