Legal Justification
Due to a lack of a local and national market provision which is a nationally recognised problem, the Cornwall & Isles of Scilly Drug and Alcohol Action Team was successful in securing a capital grant of £1.5m from the Department of Health Tier 4 Capital Build programme in 2009 to build a local Assessment, Stabilisation and Detoxification service for adults. The service opened in 2010, operating to a specification and contract drawn up by CIOSPCT (the DAAT team). Prior to this, placements were made out of area, with very poor patient experience and outcomes. Several years of attempts to stimulate the market locally, and over the borders, had been unsuccessful, hence the national capital build fund. This contract has been in place since 2015 and the current contract will end 31 March 2021. Cornwall Council are proposing to evoke The Public Contract Regulations 2015, regulation 32. (2 (b)(ii) i.e. directly awarding a contract to an economic operator without prior publication on the grounds that competition is absent for technical reasons. There are no alternative services within the county and the risk of making placements outside of the county is that they do not achieve good outcomes or experiences for service users and potentially put service users at additional risk as well as not offering value for money and impacting adversely upon our carbon footprint.
