Legal Justification
The modification has been brought about by circumstances that could not have been foreseen by Zero Waste Scotland at the time the contract was originally awarded, namely the Covid-19 global pandemic, which has severely limited the services that can be provided through this contract and which cannot be resolved by either Zero Waste Scotland or the contractor. The modification extends the original term of the contract by a further twelve (12) month period to allow continued provision of the service where practical in consideration of ongoing Covid-19 restrictions and the potential identification, development and tendering of the same or an amended service suitable to a post-Covid-19 landscape. The modification is to the term of the contract only and does not include an increase in price from the original estimate for the contract.
Other Information
The modification is permissible under Article 72(1)(c) of Directive 2014/24/EU on Public Procurement, and Regulation 72(1)(c) of the Public Contracts (Scotland) Regulations 2015. Zero Waste Scotland has incorporated a ten (10) calendar day standstill period before this contract will be modified. Any appeal should be directed to the contact details provided in I.1) above within this standstill period, which shall begin on the day after the date of dispatch of this notice on the Public Contracts Scotland web portal.
