Legal Justification
This notice relates to Storage and Handling Service for Hand Sanitiser. The Contracting Authority has utilised Regulation 32(2)(c) of the Public Contract Regulations 2015 (as amended) which provides a derogation from the obligation to competitively tender for a contract for goods or services over the EU Threshold where the works, supplies or services are required as per the below: '(c) insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with.' Regulation 32(2)(c) has been utilised in this instance due to the following rationale: Suitable storage for ethanol based hand sanitiser was required on an urgent basis to meet fire safety and DSEAR requirements. Stock was purchased to enable the Health Care System in NI respond to the Covid-19 Pandemic and has no suitable capacity within the existing premises to meet the need. A DSEAR Risk Assessment was carried out and identified a high level of risk to life and property and had to move the sanitiser without delay to suitable premises. This risk assessment meant that this was unforseeable and could not have been predicted and was actioned to deal with the extreme risk. In the event of loss or damage to the stock it would have a serious impact on the ongoing availability of hand sanitiser across HSCNI.
