Description
DurhamWorks is looking to develop a provider panel which can deliver tailored bespoke support to 16-24 year old participants who are Not in Education, Employment or Training (NEET)/unemployed with a specific focus of progressing participants into paid employment. Other outcomes may be fundable, these will be defined in each competed call-off.

Legal Justification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU) Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances: Covid-19 extension — 2020 As detailed in procurement policy notice PPN01/20 extending or modifying a contract during its term under Regulation 72(1)(c) states: contracts may be modified without a new procurement procedure in any of the following cases: (c) where all of the following conditions are fulfilled: (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract; (iii) any increase in price does not exceed 50 % of the value of the original framework
Other Information
To modify the above contract, as permitted under the Public Contracts Regulations, to include the following additional works/services: The provider panel for DurhamWorks Employment Routeways to be modified as per Regulation 72(1)(c) of the Public Contract Regulations as all of the following conditions have been fulfilled: • the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; • the modification does not alter the overall nature of the contract; • any increase in price does not exceed 50 % of the value of the original contract or framework agreement. The Covid-19 pandemic and subsequent national lockdowns could not have been foreseen, the services to be provided are the same and therefore does not alter the overall nature of the contract and the increase in value does not exceed 50 %. Original contract price awarded GBP 700 000. Increase the agreed contract price by GBP 330 000 in respect of this modification.
