Description
Supply and In Service Support of Finning DAN Forklift Trucks
Total Quantity or Scope
The Air Commodities Team, part of the UK Ministry of Defence ("the Authority") intends to extend the existing In-Service Support contract ACCOMM/00047 - Supply of Finning Dan Forklift Trucks with Briggs Equipment Ltd for an additional 12 months, moving the contract expiry date from May 6th, 2021 to May 6th 2022. Briggs Equipment Ltd are the existing supplier for this requirement and the extension of ACCOMM/00047 will enable the Authority's current equipment, consisting of 22 x Finning Dan forklift Trucks (FLT) to continue to be supported within the original scope of the Contract. The extension has an estimated value of £0.132M.. Considering timescales and the complexity of the requirement, if the contract were not be extended in this instance, it is likely a gap in technical knowledge and capability would jeopardise the safe operation of the fleet of vehicles and would cause significant inconvenience or substantial duplication of costs for the contracting Authority.

Legal Justification
It is considered that the contract can be extended in accordance with Article 2014/24/EU of the European Parliament and of the Council (Regulation 72(1)(b) of the Public Contracts Regulations 2015): 72.—(1) Contracts and framework agreements may be modified without a new procurement procedure in accordance with this Part in any of the following cases:— (b)for additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor— (ii)would cause significant inconvenience or substantial duplication of costs for the contracting authority, Considering timescales and the complexity of the requirement, if the contract were not be extended in this instance, it is likely a gap in technical knowledge and capability would jeopardise the safe operation of the fleet of vehicles and would cause significant inconvenience or substantial duplication of costs for the contracting Authority. The Authority continues with its intent to conduct a competitive procurement activity for the long term requirement, which is anticipated to be awarded prior to the completion of the extended period of performance.
