Legal Justification
This contract was extended by 12 months to expire on 30 September 2021. Notification of this extension and a rationale for it was provided in modification notice 2020/S 092-221171. This modification notice covers the extension of the contract by a further 12 months, to expire on 30 September 2022. As explained in modification notice 2020/S 092-221171, the complex nature of the project to which the contract relates necessitates legal support from advisers that are familiar with all aspects of NEST's operations and functions to ensure (for the benefit of the public) that NESTs statutory function continues to be delivered. In addition, deferring the procurement of a new legal panel to spring 2022, when business activities will hopefully be more stable from a Covid perspective, would enable the procurement to be undertaken more effectively. The extension is justified on a procurement law basis by Regulation 72(1)(c) Public Contracts Regulation 2015 and government guidance CCS PPN 01/20.
Other Information
The value of the contract is based on the total estimated legal spend across all three lots which were procured for legal services at the same time. There is no guarantee as to volume of work or level of fees for any of the firms. The basis for division of the work between the lots was based on: 1) A principle legal provider under this Lot 1 to handle large high value and complex queries relating to NEST’s obligations as a trustee of the scheme and as a non-departmental public body, complex and unique pensions queries and matters relating to the management of the scheme administration contract; and 2) Legal support from the other two lots to handle day to day IP queries, data protection matters, one-off general commercial queries and commodity work. Values were not assigned to each lot due to expected fluctuation over the period and need for flexibility.
