Legal Justification
The council has awarded the contract in reliance on the grounds for making a direct contract award provided under Regulation 32(2)(c) of the Public Contract Regulations 2015 the unforeseeability of the second COVID lockdown announced on 31st October 2020 led to a decision by Government to require Councils to distribute the COVID Winter Grant fund with effect from 1st December 2020. Notification of the said decision was not received by the Council until 8th November 2020, hence the council did not have sufficient time to undertake a procurement exercise and then mobilise and implement an alternative solution in the time available. Moreover, Auriga Ltd had operated the Council’s Welfare Contract and assisted with the distribution of the Summer Emergency Assistance Grant for the council, in which case it already had in place the necessary resources and systems to provide the required services at short notice.
