Description
The Contracting Authorities established a Framework Agreement for the regular supply of: > Medical Face Mask meeting the full requirements of EN 14683:2019 - Type I; > Medical Face Mask meeting the full requirements of EN 14683:2019 - Type IIR.
Total Quantity or Scope
Linc-Cymru Housing Association Ltd in collaboration with Pobl Group Ltd and Community Housing Cymru ('Lead Contacting Authorities') established a Framework Agreement for the regular supply of Medical Face Masks conforming to EN 14683. The appointed providers are required to make deliveries to various locations throughout Wales and to one location in Bristol. The appointed providers must source and arrange the logistics for delivery of the primary object of this contract. This includes having capacity to receive direct orders from and separately invoice all Contracting Authorities that are able to buy via this Framework Agreement. The regular supply of medical face masks is the primary object and core requirement of the Framework Agreement.

Renewal Options
The appointed providers may be requested to supply other PPE and wearable items as may be required in line with updated official Government or Government Agency Guidance relating to PPE for the COVID-19 response (‘Associated Items’). In all circumstances, the providers will be requested to submit a proposal or quotation for supply of Associated Items. This proposal or quotation will be bench-marked against alternative sources of supply. The request for the supply of Associated Items may be made at any time during the Framework Agreement. The requests will be strictly limited to supply of Associated Items for urgent provision of business and safety critical PPE and other wearable items as may be specified from time to time in official Government or Government Agency Guidance relating to PPE for the COVID-19 response.

Legal Justification
The COVID-19 outbreak gave rise to an urgent need for the supply of Medical Face Masks because they are not something usually used by the buyers party to the Framework Agreement but were mandated in accordance with the contemporaneous infection control and PPE guidance published by HM Government, Welsh Government and their executive agencies. This did not give the Lead Contacting Authorities sufficient time to comply with the standard open procedure timescales for the procurement. The Lead Contracting Authorities considered this to be a state of urgency which it duly substantiated. Accordingly, The Lead Contracting Authorities used the accelerated time limits permitted under the Public Contract Regulations 2015 Regulation 27(5) for the open procedure in respect of this procurement.
