Legal Justification
The International Guns, Missiles and Rockets Project Team (part of the United Kingdom Ministry of Defence (UK MOD)) intends to place a contract with Raytheon UK to assess for the benefit of UK MOD whether Paveway IV MK2 (the Weapon System) can be safely integrated onto Protector RG-1; to identify matters relating to such integration requiring resolution; and (once such matters have been resolved) to certify safe operational integration (the Services). The estimated, total value of the contract is £3.2m(ex VAT). The contract is due to expire 14 months after its commencement date. It is considered that this contract can be entered into by the UK MOD using the negotiated procedure without prior publication of a contract notice under Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (SI 1848). This is on the basis that for technical reasons the contract may be awarded only to Raytheon UK. Raytheon UK is the sole co-ordinating design authority for the Weapon System and alone has the technical knowledge and expertise to assess and support the safe integration of such system onto Protector RG-1 and accordingly provide the Services.
