Description
A framework agreement covering the period from April 2022 to March 2026 for carrying out minor civil engineering works, primarily on behalf of Devon County Council but also on behalf of its Partner Organisations. Each Work Order issued through the framework will have an estimated value of between 0 GBP and approximately 1 500 000 GBP. The type of works that are expected to be commissioned will be varied but will primarily involve improving, developing and maintaining the following DCC assets: highways, highway structures, foot/cycleways, waste management sites and flood risk management measures. The framework will be split into 3 Lots. These will cover the following values: Lot A: 01 April 2022 - 31 March 2024: - Lower Limit: N/A - Upper Limit: £80,000 01 April 2024 - 31 March 2026: - Lower Limit: N/A - Upper Limit: £88,000 Lot B: 01 April 2022 - 31 March 2024: - Lower Limit: £65,000 - Upper Limit: £500,000 01 April 2024 - 31 March 2026: - Lower Limit: £71,500 - Upper Limit: £550,000 Lot C: - Lower Limit: £475,000 - Upper Limit: £1,5000,000 01 April 2024 - 31 March 2026: - Lower Limit: £522,500 - Upper Limit: £1,650,000 The framework agreement will be based upon the NEC4 Framework Contract with individual Work Orders based upon the NEC4 Engineering and Construction Contract. The number of schemes that will be issued through the framework is currently unknown. Spend for the total framework is £45,000,000, with historic spend data contained within the supplementary information found in Volume 8 of the procurement documents.

This Contract is being let for the benefit of Devon County Council and the following organsiations: • Dartmoor National Park Authority • East Devon District Council • Exeter City Council • Exmoor National Park Authority • Mid Devon District Council • North Devon District Council • South Hams District Council • Teignbridge District Council • Torridge District Council • West Devon Borough Council Tenderers may submit a Tender for a single Lot or Tenders for multiple Lots. There is no limit on the number of Lots a Tenderer may be successful in being awarded a place on. The number of Suppliers awarded a place on each Lot can be found within the Tender Documents. Tenderers should be aware that the authority does not guarantee the number of projects that will actually be undertaken or the number of projects to be carried out by any of the framework Suppliers. The authority reserves the right to cancel the procurement process at any stage. The authority does not bind itself to accept the lowest or any tender, and reserve the right not to award a contract. The authority reserves the right to award the contract in part, or to call for new tenders should they consider this necessary. Economic operators remain responsible for all costs and expenses incurred by them or by any third party acting under instructions from them in connection with their participation in this procurement, whether incurred directly by them or their advisors or subcontractors and regardless of whether such costs arise as a consequence direct or indirect of any amendments to documents issued by the authority at any time, or as a consequence of the cancellation of the procurement by the authority. For the avoidance of doubt, the authority shall have no liability whatsoever to economic operators or their advisors or subcontractors, for any of their costs, including but not limited to those for any discussions or communications. Any contract(s) or agreement(s) entered into as a result of this contract notice shall be considered as a contract(s) or agreement(s) made under English law and subject to the exclusive jurisdiction of the English courts. If an economic operator considers that any information supplied by it during this procurement process is commercially sensitive or confidential in nature, this should be highlighted and the reasons for its sensitivity as well as the duration of that sensitivity specified. Economic operators should be aware that even where they have indicated that information is commercially sensitive, the authority may disclose it pursuant to the Freedom of Information Act 2000 in response to a request for information where such disclosure is considered to be in the public interest. Please note that the receipt by any of the authority of any materials marked 'confidential' or equivalent shall not be taken to mean that the authority accepts any duty of confidence by virtue of that marking.
