Legal Justification
Funding for this contract has been provided by the Office For Students which has strict conditions with regards to timelines by which the funding provided has to be spent. Any delay in awarding this contract would risk the Office For Students withdrawing funding from Oxford Brookes University. ST Engineering Antycip proposes a CAVE system that will be designed to meet the University's available room space taking into account the physical constraints imposed. This has led to the selection of an advanced polymer fabric screen which is unlike any other in the market today for ease of entry and only created by one manufacturer ( BARCO) whom STE Engineering Antycip is the preferred certified supplier in the United Kingdom. ST Engineering provides the advanced polymer fabric screen material that enables transportability, key for Oxford Brookes as the solution needs to enter the Wheatley Campus building for access purposes and needs to be re-deployed in the future at the Oxford Based Campus necessitating ease of handling and transport. Solid Screen substrates ( Glass/acrylics etc ) are rigid by nature and would prohibit ease of entry to the room space combined with an increased cost for handling and transportation along with increased risks for damage to occur in the process. As a result, the Oxford Brookes University believes that Public. Contracts Regulations 2015, Regulation 32(2) applies. Regulation 32(2) states: "The negotiated procedures without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases:- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons:- (ii) competition is absent for technical reasons..." (c) insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with.
