Legal Justification
Lisburn & Castlereagh City Council Council have a Kerbside Sort Contract. This contract was awarded, via a competitive tendering procedure, to Bryson Recycling. The contract commenced on 1st November 2017 for a period of 1 year with the option to extend for a further 2 years, with the contract end date being 31 October 2020. The contract was further extended for a period of a maximum of 21 months. This direct award is being let on the basis of there being a need to ensure business continuity in light of the unforeseen circumstances brought about by the Covid-19 pandemic and where the Council’s existing service supplier (Bryson Recycling) is the only contractor capable of providing continuity of service provision for this requirement. This direct award is permitted by Regulation 72(1)(b) of the Public Contracts Regulations 2015. • Where there is genuinely only one provider who is capable of meeting the requirement or will be interested in doing so; (PCR 2015 Regulation 32 (2) General Grounds,(b)(i)(ii)(iii)) and, • In the case of an individual contractor where it is necessary for business continuity to retain a specific individual; (PCR 2015 Regulation 32 (5)(b)) During this newly established contract, work will be on-going at both local and regional level in order to finalise the Councils future needs and procure a new contract through an open competition.
