Legal Justification
The Contracting Authority made a direct award under Regulation 32(2)(c) of the Public Contract Regulations 2015 in order to secure additional hospital capacity and services throughout Wales to support the National Health Service during its response to the COVID-19 pandemic. Due to events that were unforeseeable by the Contracting Authority (i.e. the covid-19 pandemic), the time limits for the open or restricted procedures with negotiation could not be complied with.
