Legal Justification
The Air Commodities Delivery Team (ACDT), part of the UK Ministry of Defence (MoD), intends to place a new 4-year Contract with L'Hotellier for the provision of Spares, Repairs and Post Design Services (PDS) for aircraft fire-fighting equipment, life raft inflation equipment and inertia switches used aboard 15 different Royal Air Force (RAF) platforms. The estimated Contract start date is 1st April 2022 and the estimated Contract value is £6.715M (Inc. VAT). In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations (DSPCR) 2011 for the technical reasons set out below. L’Hotellier possess the original design rights for the majority of the equipment, much of which is only supplied or licensed by L’Hotellier. L’Hotellier is the only company with the experience, product knowledge and historical data to undertake the PDS activities and it is not considered possible for another economic operator to become sufficiently qualified, within the necessary timeframe, to undertake PDS investigations and fault investigations without incurring an unacceptable level of risk. This would result in the Authority being unable to fulfil its safety obligations to ensure safe operation of the associated platforms and aircraft systems within an airworthy environment. To consider another supplier to meet this requirement would potentially create Aircraft on Ground (AOG) scenarios across the 15 aircraft platforms that rely upon this equipment.
