Legal Justification
The Contract is to be awarded to Briggs Equipment UK Limited (Briggs) pursuant to Regulation 50(1)(c)(ii) of the Utilities Contracts Regulations 2016 (the Regulations). For the reasons set out below, Warrenpoint Harbour Authority (WHA) is of the view that the Contract can only be awarded to Briggs because competition is absent for technical reasons, and no reasonable alternative exists. Having undertaken research on the forkilifts available in the market, WHA is of the view that the Combilift C16000 is the only product in the market that is capable of fulfilling its technical and health and safety requirements, due to its multi-directional , side loading, 900mm load-base and load lifting capacity, which will enable consistent low level carriage of steel beams within spatially constrained aisles in WHA's steelyard. WHA understand that the C16000 is the only multi-directional forklift in the market with a 16 tonne capacity. WHA have been informed by Combilift that Briggs is the relevant sales agent from whom WHA can purchase the C16000s that meet its technical requirements. In light of the above, WHA is of the view that if it were to put the contract opportunity out to tender in accordance with the Regulations genuine competition for it would be absent, and in the circumstances there is no reasonable alternative to the Combilift C16000.

** PREVIEW NOTICE, please check Find a Tender for full details. ** Warrenpoint Harbour Authority intends to enter into this contract following a minimum 10 day calendar day standstill period starting on the day after this notice is published in the UK Find a Tender Service . The Utilities Contracts Regulations 2016 (the Regulations) provide for aggrieved parties who have been harmed or who are at risk of harm by a breach of the Regulations to bring proceedings in the High Court. Any such proceedings must be brought within the limitation period specified by the Regulations according to the remedy sought.
