Legal Justification

It has been determined that the appropriate route to market for this requirement is the use of the negotiated procedure without prior publication in accordance with The Public Contracts (Scotland) Regulations 2015, Regulation 33 – Use of the Negotiated Procedure without Prior Publication; - (1) A contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases - b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons - (ii) competition is absent for technical reasons. The University intends to contract with our current economic operator for the extension and partial replacement of gym equipment to ensure identical functionality throughout all sites.
