Description
Land and Property Services is placing this voluntary transparency notice to alert economic operators of its intention to modify the Maintenance and Development of Pointer System contractt in accordance with Regulation 72 (1) (b) of the Public Contracts Regulations 2015. This transparency notice does not place any obligation on the Authority to enter into this modification.

Legal Justification
On 29 April 2015 the Contract known as "DoF - Land and Property Services - Maintenance and Development of Pointer System" was awarded to Version 1 Software. The total value of the Contract was £749,140 over a period of 7 years. The Contract is due to expire on 30 April 2022 and a procurement is underway to secure a replacement. To ensure continuity of service to LPS for their critical business functions whilst the requirement is retendered LPS requires an extension of its original contract for an additional 12 months (with the option of a further 6 months - 18months in total). In this case, LPS will seek to rely on the modification provisions of 72(1)(b) due to the near technical impossibility for another economic operator to achieve the required performance within the time permitted; and the necessity to use its specific know-how, tools and means which only the current Contractor has at its disposal. Also a modification of £160,530 does not exceed 50% of the value of the original contract.
