Legal Justification
These modifications are made under the provisions set out in Regulation 72 (1) (d) (i). The need for contract modification has been brought about by circumstances which have meant resources in the Economic Operator have been diminished and they can no longer support the full contract which was awarded.
Other Information
Lot 1, Section 1.4 – Southern HSC Trust originally awarded to Ace Drains Limited has been terminated and an award made to the supplier ranked 2 in the original tender evaluation, McAllister Bros Limited. This modification is in accordance with the SS20a Scoping and Specification provision contained within Clause 1.8 – Award of the Contract and Regulation 72 (d) (i).
