Legal Justification
During the COVID 19 pandemic, staff who would have been deployed to manage a re-procurement of this contract were diverted to undertake COVID 19 emergency response activities. Consequently, re-procurement of this contract was delayed. The contract involves complex TUPE issues, which impact upon the structure of the re-procurement. Due to redeployment of staff as a result of COVID 19, the TUPE issues could not be addressed at an earlier stage. This contract directly affects service users and their care, which also impacts on the structure of the re-procurement. Given the complexity of the issues involved to re-procure these services, the existing contract will be extended by 11 months to enable an appropriately structured re-procurement to be undertaken.
