Legal Justification
Leading Resolutions was the successful bidder of a previous RFQ process to provide an independent review of the ongoing digital transformation programme. Their success was based on a combination of industry experience, agile methodology knowledge, and price. Hyde has since made the decision to employ support for the upcoming phases in the programme delivery of the digital transformation, and Leading Resolutions have a unique understanding of the programme combined with the technical knowledge to enable them to provide this support in a seamless fashion allowing the programme to continue at pace. The phased nature of the engagement may feasibly mean that the contract will be below the threshold level for the regulations so this notice is seen as a prudent step. By issuing a full tender, the Contracting Authority would experience delays to the programme, which would incur a disproportionate financial impact to the business when compared with the potential value of this contract. This would of course need to be factored into any procurement exercise, which leads us to the conclusion that competition would be absent.
