Description
This is a Contract Award Notice made by the Contracting Authorities; NHS Basildon and Brentwood Clinical Commissioning Group (as lead commissioner), and NHS Thurrock Clinical Commissioning Group (hereinafter referred to as “the Authority”) in compliance with their local standing financial instructions (SFIs), to various providers to to deliver Primary Care Multiple Use Community Services (MUCS), covering the population of Basildon and Brentwood, for a period of 12 months, from 1st April 2022 – 31st March 2023. This Contract Award Notice follows the Voluntary ex ante transparency notice (2022/S 000-007494) published: 18 March 2022. The aggregate potential AQP value across all 33 providers for a 12 month period is forecasted at £22,477,424 (including VAT), equating to £18,731,186 (excluding VAT).
Total Quantity or Scope
The Services include; provision of 24-Hour BP Monitoring Services, 24 Hour ECG Monitoring Services, Shared Care Services, Minor Injuries Services, Secondary Care Wound Management Services, 12 Lead ECG Services, DVT Services, and Vasectomy Services for the population registered with General Practitioners (GP) in Basildon & Brentwood CCG. This Notice is being issued using an aggregate AQP value based on actual spend over all providers of MUCS services between 01/04/21 - 30/09/21. … The Contracting Authority is yet to agree appropriate inflation and uplift for this contract for the period of 2022/23 and 2023/24. These will be dealt with as Contract Variations in accordance with the NHS Standard Contract Terms and Conditions. The Authority deems any such variations are not substantial or material changes, as they occur due to external causes beyond the Authority's control, including changes in contract value driven by changes in patient volume. The Authority will publish appropriate Notices accordingly to communicate any such future changes to the market, once final.

Legal Justification
The Service falls within Schedule 3 (‘social and other specific services’, also known as the “Light Touch” Regime) of the Public Contracts Regulations 2015 (PCR 2015) as amended by The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 (‘PPAR 2020’). These contracts were previously let under an AQP model in 2018, to 33 various General Medical Practice providers between 30th October 2018 to 2nd April 2020 (with option to extend for a further 12 months until 2nd April 2021). This was on a zero value basis, with no guarantee of any volume. 'Call off' for a Provider's Services is initiated by the patient's choice of that Provider from a list (managed by the Commissioner) of all Providers holding an AQP Contract. The AQP was rolled over for a further year post the expiry date of the extension period, as an emergency due to the unforeseeable nature of events during the Covid pandemic, that were outside of the Authorities influence. The Authority is currently in a transitional period with the expectation to be superseded as a statutory body, by an Integrated Care Board in late 2022. The organisation shall have a key function as part of the overall Integrated Care System. At the current time, longer-term strategies across all sectors are under discussion and longer term commissioning decisions and or procurements cannot take place until these legal arrangements are confirmed. The Authority has therefore taken a decision to award a contract to each of the incumbent providers of MUCS under the AQP as they are considered to be the most technically capable providers in the current environment and within the geography of Basildon and Brentwood, whilst transitioning to the ICB, to ensure quality, safety and consistency in provision of care that meet the needs of the population during this transition period.
Other Information
The Service to which this procurement relates fall within Schedule 3 of the Public Contracts Regulations 2015 as amended by as amended by The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020, (the "Regulations"). As such, the Contracting Authority does not intend to hold itself bound by any of the Regulations, save those applicable to Schedule 3 Services.
