The Engineering Delivery Partner will provide engineering and environmental services including design development primarily taking place during the period between the issue of the main civils contract ITT's and the appointment and mobilisation of the ECI contractors to support HS2 Ltd in the coordination, integration and control of engineering and environmental design, development and mitigation, design assurance, construction, testing and commissioning and other ancillary services to ensure success for HS2 railway and systems design.

Legal Justification

This is a voluntary ex ante transparency notice (“VEAT Notice”) pursuant to Regulation 114 of the Utilities Contracts Regulations 2016 (“UCR”) relating to a variation agreement to increase the value of an awarded contract. The Engineering Delivery Partner framework (2016/S 119-212759) was awarded in 2016, the framework had a duration of 120 months with an option to extend for up to a further 24 months (intervals of 12 months). The total value of the framework was £350,000,000. A modification notice (2018/S 193-437609) was issued in 2018 to include additional scope, HS2 Phase 2a from West Midlands to Crewe. This modification increased the total value of the contract by £20,000,000 to £370,000,000. This VEAT Notice is being issued to confirm that that High Speed Two (HS2) Ltd intends to enter into a variation agreement increasing the total value of the contract by £127,000,000. The total contract value after executing the variation agreement excluding VAT is 497 000 000.00 GBP The increase in contract value is to account for a higher volume of services being required than originally estimated. The scope of the services has not changed, and there is no change to the overall duration of the contract award from that included within the original contract award notice 2016/S 119-212759. High Speed Two (HS2) Limited considers that the increase in contract value is a modification that does not require a new procurement procedure in accordance with the UCR as the increase in contract value is not a modification that is substantial within the meaning of Regulation 88(7) of the UCR. High Speed Two (HS2) Limited intends to enter into the variation agreement not sooner than 10 days after the date that immediately follows the date of publication of this VEAT Notice.
