Legal Justification

The multiple-wave nature of the COVID-19 pandemic and its effects could not have been foreseen by the Department for Infrastructure and it has resulted in delays to the procurement exercises for new replacement contracts, including the Interim Term Contracts for Asphalt Resurfacing (ITCAR) programme. There is a need to introduce asphalt resurfacing tender competitions, including the ITCAR programme, in a controlled manner so that there is a continuous, manageable pipeline of tender opportunities over the next 12 months that meets the needs and capacity of both DfI and the roads construction industry. A short extension to the three live asphalt resurfacing term contracts will therefore allow a level of service to be maintained whilst the delayed Phases 3 & 4 of the ITCAR Programme are delivered through open competition. The Department intends to modify each of the three existing Term Contracts for Asphalt Resurfacing 2015: ARN1, ARE2 & ARN3 by extending the contract term by a period of up to six months, until 8 February 2023 at the very latest. Should a replacement contract be awarded through Phases 3 & 4 of the ITCAR programme before 8 February 2023, the relevant existing contract will be terminated with one month notice. The value of each contract modification will be limited to £4,447,000 (ex VAT) and the overall nature/scope of each contract will be unaltered. These proposed modifications will be in accordance with Regulation 72(1)(f) of the Public Contracts Regulations 2015. The Department for Infrastructure does not intend to issue further notices regarding these modifications.
