Services for the Collection & Recycling Of Rubble From Council Household Recycling Centres in the Lisburn and Castlereagh City Council Area.
Total Quantity or Scope
The contract is for (a) the collection and recycling of the specified contract waste and (b) to collect data and produce reports detailing the quantity of contract waste collected and the final/end destinations of all outputs. Contract waste will comprise of rubble, to include ceramic tiles, toilets and basins.

Legal Justification
This relates to the variation of an existing contract. Proposed cost increases to the existing contract are attributable to the on-going increasing costs associated with transport and processing (eg fuel, particularly the move from red to white diesel, energy and staffing) which have been fuelled by not only Brexit and economies restarting following Covid but also the more recent increase in National Insurance costs. The Russia/Ukraine war has also exacerbated fuel and energy costs on a global level. Due to the current uncertainty and volatility around fuel and energy costs an extension of 6 months has been proposed. As the contract exit date will be 11 November 2023 further extensions under the contract are available to the Council. The council are content that the proposed increased rates still represent value for money in terms of the original procurement. It is reasonable to assume that contractors would not have foreseen the current cost increases in delivering services under the contract at time of tendering. This direct award is permitted by Regulation 72(1)(c) of the Public Contracts Regulations 2015 (c) where all of the following conditions are fulfilled:— (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract; (iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.
