Legal Justification
Following an open procedure in accordance with the Public Contract Regulations, and the Council's standing orders, only 1 tender was received. Following a full evaluation, the Council determined that under 32 of the Public Contract Regulations, it was not a suitable tender being manifestly incapable of meeting the Council's needs, for the following reasons • the bidder did not submit a form of tender, although required to do so • the bidder did not meet the selection criteria under part three of the selection questions technical and professional ability, failing to provide the required three references for similar contracts nor completing section 6.3 setting out why this was not possible. Failing to complete this section is a pass/fail and means that the bid would not proceed to an award stage and can be discounted. Although this provision under section 32 of the Public Contract Regulations would permit negotiation with one economic operator, in these circumstances, the Council nonetheless invited two interested companies to consider the tender documentation and gave an additional period in which they could submit a tender, in accordance with the same specification. Only one company did so. The tender was assessed as being fully compliant and following a stand-still period, a contract award has been made.
