Description
The original tender for an Integrated Consultant team to take forward the Hillsborough Public Realm Scheme was awarded to the Paul Hogarth Company Ltd. This variation to contract is required to appraise and update drawings and related documentation
Total Quantity or Scope
As a consequence of the changed scope of the Destination Royal Hillsborough Belfast Region City Deal funding, there now requires a significant change in contract requirements since the original Paul Hogarth Company Ltd commission was tendered. This new variation to contract is required to appraise and update drawings and related documentation to prepare for planning submission and subsequent planning approval of the Royal Hillsborough public realm scheme so that investment in the public realm can be expedited. These costs have been quoted by the Paul Hogarth Company Ltd and will comprise of the completion of site surveys and consultations, development of detailed drawings and reports, preparation of information for Pre-Application Discussion (PAD), Pre-Application Community Consultation (PACC) and planning submission, plus the completion of an economic appraisal for submission to the Department of Communities (DfC).

Legal Justification
Under Regulation 72 (c) In this instance the need for the modification was brought about by a change in the requirements of the City Deal funding process which has led to a requested change in scope and delay in the expected investment decision date which the Council did not foresee at the early stages of the bidding process. Under Regulation 72 (b) A change of contractor cannot be made due to the fact that the Paul Hogarth Company Ltd have secured the main commission for this work and it would not represent value for money to secure the services of an alternative contractor due to the potential inconvenience and substantial duplication of costs such engagement would create. The additional contract variation of £81,157 will increase the total contract to £405,977.36 and is within the 50% rule under Regulation 72.
