This DAC is for the continued provision of a website and notification management system that the Commission requires to fulfil its statutory duties to allow sufficient time for a new solution to be implemented.

The current system is owned and managed by the provider who has exclusive rights to its products, the DAC will permit time for the system to be brought in house.

Legal Justification

The Authority will rely on a derogation- in this case regulation 32(2)(b)(ii) - Where competition is absent for technical reasons and regulation 32(2)(b)(iii) - For reasons connected with the protection of exclusive rights, including intellectual property rights as the supplier’s solution is bespoked and fully aligned to the Commissions processes and statutory requirements/obligations. The Commission will also rely on derogation 32(2)(c) as work is due to commence on the insourcing of the longer term solution and the Commission do not have the resources nor budget to duplicate costs/resources in running two separate processes.
