Description
Central Bedfordshire Council wishes to contract for the provision, installation and maintenance of bus shelters and timetable cases at bus stop locations around Central Bedfordshire, to be funded by Bus Service Improvement Plan monies received from Department for Transport during the period 2022/23 - 2024/25.
Total Quantity or Scope
The Bus Service Improvement Plan envisages the installation of 40 new bus shelters each year at locations around Central Bedfordshire during the life of the BSIP (2022/23 - 2024/25). The Plan envisages that some of these shelters will be high-spec "super-shelters" to be installed at stops along the Luton - Dunstable Busway corridor, others will be standard shelters of various designs to be installed at other locations throughout the Central Bedfordshire area. The contract will also cover maintenance and repair of the shelters once they are installed.

Legal Justification
The Council has used the negotiated procedure without prior publication under Regulation 32.(5)(b) for the following reasons. Externiture already have a contract with Central Bedfordshire Council to supply, install and maintain bus shelters throughout the local authority area and when providing additional public transport infrastructure as a result of BSIP funding, the Council wishes to promote a uniformity of appearance, style and design as part of a consistent transport branding throughout Central Bedfordshire. This will assist with customer recognition of public transport facilities which in turn will encourage the use of public transport and so help the authority to achieve its sustainable transport objectives. With this objective in mind, it is essential that shelters throughout the local authority area are provided by the same supplier in order to ensure uniformity of equipment provided. Secondly, the use of a sole supplier for public transport infrastructure facilitates the installation and maintenance of shelters as all equipment, parts and replacements are available from the same supplier and installation and maintenance of all facilities can be carried out by the same supplier throughout the area. Equipment provided by other suppliers would not offer uniformity of appearance, would not offer interchangeablity of parts and spares and would have different installation and maintenance requirements. If shelters were to be obtained from multiple suppliers, the authority would need to deal with different suppliers with regard to the installation and maintenance of shelters in various parts of the authority area. In addition, working with an existing supplier will enable the infrastructure upgrades planned with the BSIP funding to be implemented more quickly and so ensure compliance with DfT timescales. Lastly, Externiture are approved to install Real Time Passenger Information screens procured by the council from another supplier, Vix Technology, through a separate contract. This partnership working between two suppliers achieves a cost saving to the council of £200 per installation, which would not be available if shelters were provided by alternative suppliers.
