Legal Justification
The Naval Base Command Devonport (NBC(D)) team, acting on behalf of the UK Ministry of Defence (MOD), hereby provides notice that, in the ‘absence of tenders or suitable tenders’ in response to a previous restricted procedure (ITT 702785451), for the Provision of Reception Centre Services at HMNB Devonport, it shall implement a procedural switch in accordance with regulation 16(1)(a)(i) of the Defence and Security Public Contract Regulations (DSPCR (2011)). In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with regulation 16(1)(a)(i) of the DSPCR 2011 in the absence of any tenders being submitted in response to the restricted procedure. The MOD has subsequently assessed the offered scope and associated documentation. The conclusion of this assessment is that the requirement remains valid. In order to comply with Health and Safety Legislation, MOD Policy & Regulatory requirements and provide the appropriate security effect to HMNB Devonport; the MOD intends to place a contract using the negotiated procedure without prior publication of a contract notice to negotiate with Devonport Royal Dockyard Limited (DRDL), on the basis that the original terms of the proposed contract offered in the discontinued restricted procedure will not be substantially altered. The contract duration remains unchanged from the restricted procedure and shall cover an initial period of 5 years with further options to extend the contract period for a maximum of 2 years.
