Legal Justification
Single Source Procurement for Provision of a support contract for Mode 5 crypto computers from Hensoldt France SAS (FRANCE) Voyager Delivery Team (DT), as part of the UK Ministry of Defence (MOD), intends to award a contract to Hensoldt France SAS for the support and maintenance of the QRTK3BNG and QRTK4NG crypto computers. These are Controlled Cryptographic Items (CCI) used on Mode 5 Identification Friend or Foe (IFF) systems. This particular type CCI has been classified as Type 2: Unclassified and encrypted equipment for government information that requires safeguarding due to data sensitivity The contract is intended to be let for a 3-year period, plus 2 option years with an anticipated contract value of £0.300M Reason for Award: Hensoldt France SAS are the Original Equipment Manufacturer (OEM) of the crypto computers used for Mode 5 on Voyager. They are the only organisation that can service and repair the units due to technical reasons. Accordingly, it is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 due to technical reasons.
