Legal Justification
The award of this contract is permitted under The Public Contracts Regulations (Scotland) 2015, Pert 2, Chapter 1, Section 1, 13-(b) In that the procurement is not subsidised by any public funds/ public sector authority by more than 50%. It have been deemed by Edinburgh Leisure that for both commercial and operational reasons, cutting short our current contract with the incumbent supplier in order to facilitate a new contract on implementation of new suits of services is the best option for the following reasons. The cost of implementation, set-up and training, to name a few areas would make any competition extremely difficult with our incumbent supplier who have worked hard to establish a very good, efficient and effective system. It has been deemed that any change of provider would have negative impact of service, outcomes and other contracts.
