Legal Justification
The Regulations permit the modification of a contract where the changes proposed meet one or more of the prescribed tests as set out in Regulation 72.The permissible extensions provided for in the initial procurement documents of the contract are required to extend the contract period, therefore the Northern Ireland Policing Board will rely on Regulation 72(1)(a) and (e). Under Regulation 72(1)(e), the change, regardless of its value, is not substantial when considered against the principles set out in paragraph 8. Furthermore, it is permissible under regulation 72(a), as the extensions was provided for in the initial Contract notice and associated procurement documents and the overall nature of the contract is not being altered.The Contracting Authority intends to conclude the procurement process for the replacement of the current contract and it is anticipated to be in place at the end of the full contract term.
