Description

The Council's aim is to secure a fully integrated service that will fulfil the Council's statutory waste functions. West Berkshire District Council is seeking a service provider to deliver all resources, including facilities, infrastructure and services necessary to collect, recycle, compost, treat and dispose of all its municipal waste.

Legal Justification

The Council has recently completed a limited variation of its long-term PFI contract with the existing contractor, Veolia ES West Berkshire Limited, to enable the contractor to provide separate food waste collection services. The introduction of separate weekly food waste collections is a legal requirement under the Environment Act 2021. The existing PFI contract is integrated, meaning that the incumbent contractor is responsible for all aspects of the waste management chain including collection, recycling or disposal. It has not been considered feasible for the provision of the separate food waste service to be procured separately outside of the existing PFI contract for reasons of practicality, potential for significant delays and significant risks associated with integrating a new service provider onto the existing PFI contract specifically to deliver the food waste service. Furthermore, it is the Council's understanding that the completed contract variation to allow for separate food waste collections is allowable and lawful under current regulations.
