Legal Justification

This contract variation was required to undertake revised and additional work following the designation on a SSSI at EC. The work includes assessing the impact of the SSSI designation and revising documentation for revised planning strategy. Regulation 72(1)(c) of PCR15 allows for modifications to made if brought about by circumstances which a diligent contracting authority could not have foreseen. EDC undertook significant due diligence prior to contracting this incumbent service provider and there was no evidence that Natural England were considering a SSSI designation and this is therefore considered to be an unforeseeable circumstance.
