Legal Justification
The NHS Executives have a requirement for continuity of service for the educational and digital implementation platform in place that acts as an integrated Healthcare professional and patient support tool to deliver large scale programmes across all Wales to achieve established clinical and behavioural outcomes for the population. The system has been fully implemented for a number of years and provides a number of functions including to develop and implement national education solutions in the form of Welsh National Guidelines and Standards, providing dashboards and tools for clinical leaders, managers and commissioners to manage implementations of bespoke interventions, such as national clinical guidelines, large-scale education programmes, quality improvement, and patient support apps. ICST also provide sharing the learning through publishing and presenting at national and international conferences on what has been created, delivered and achieved in Wales. It should be noted that ICST advise that they own the intellectual property rights to the platform and service. Following a review of the service and platform, NHS Executives are decommissioning the requirement, however, there is a need for continuity of service whilst the exit strategy is being communicated and undertaken with service users. Based on the above, NWSSP Procurement Services and NHS Executives are issuing this notice applying a 10 day standstill period prior to award of this interim contract until the 31st March 2024.
Other Information
To ensure contractual arrangements remain in place to maintain the continuity of this service, the Authority intends to use the negotiated procedure without prior publication in accordance with the use of Public Contract Regulations 2015 32 (2)(b)(ii) and (iii), competition is absent for technical reasons and (2) (b)(iii) - the protection of exclusive rights, including intellectual property rights.
