Legal Justification

Regulation 72(1)(b) Additional works, services or supplies “have become necessary” and were not included in the initial procurement and a change of supplier would not be practicable (for economic, technical or interoperability reasons) and would involve substantial inconvenience/duplication of costs - provided the change does not exceed 50% of the value of the original contract. This is on the basis that, as set out by LPS, there are a number of economic and technical reasons which mean that a change of contractor at this point would result in significant inconvenience and duplication of costs including but not limited to, costs associated with running a new procurement process and the costs associated with brining another contractor up to speed on the work already undertaken by the current contractor. There is the need for continuity with financial advisory support (e.g. finalisation of Land Registry delivery partner project, R&B implementation). This extension will allow contingency for financial advisory support for these and the remaining NOVA programme procurements (Valuation) to be completed.
