Description
Bracknell Forest Borough Council is seeking to award a 2 year fixed term contract for the provision of Sexual Health Services. Bracknell Forest Borough Council is acting as the contracting authority on behalf of 2 additional Councils, these being The Royal Borough of Windsor and Maidenhead and Slough Borough Council. .
Total Quantity or Scope
The provision of this service, to the 3 named councils, is in compliance with statutory Public Health requirements for the provision of a Sexual Health Service.The provider must comply with the clinical need to provide services via at least one tier 3 clinical environment and at least one tier 2 clinical environment. These clinics must be easily accessible to all residents of the 3 boroughs.

Legal Justification
The provision of this service requires clinical facilities that are rated tier 3 and 2. The only facilities currently located in the area of operation are at two 3rd party Primary Care Trusts. The object of this award, under Regulation 32 of the Public Contracts Regulations 2015 Clauses 9, 10, 11 and 12, is to ensure continuity of Sexual Health Services. Due to the lack of alternative compliant provision, the Council is making a Regulation 32 award on the basis of the Berkshire Foundation Heath Trust being the only supplier. During this 2 year period, the 3 authorities will first be conducting a market engagement exercise with the view to expanding the opportunity to tender to other service providers, who would be prepared to establish alternative tier 3 and 2 facilities. A fully compliant procurement process for a longer term contract will be also conducted during this 2 year period, based upon the outcome of the market engagement process
