Legal Justification
The Council has awarded under Regulation 32(2)(b)(ii), where the works, supplies or services can be supplied only by a particular economic operator as competition is absent for technical reasons and no reasonable alternative or substitute exists. It is believed that this regulation is applicable for the following reasons: (1) HCL has built Derbyshire specific data loaders and gained detailed knowledge of the Derbyshire SAP system as it successfully completed three rounds of migration of 12 years worth of production data (3 TB) as well as the successful testing of 62 mission critical interfaces and full UAT including payroll regression testing. The re-use of HCL’s data loaders and fix on fail code knowledge is an accelerator and will de-risk the delivery of the programme. Selecting a new system implementer would mean that both data migration and code remediation will have to be started afresh again at a significant additional cost and a much longer delivery time. (2) For the Azure infrastructure services, HCL have a detailed understanding of the specific implementation of SAP S/4HANA as per the Council’s requirements as they were responsible for the SAP software implementation. Procuring these services from another 3rd party service provider would result in significant additional complexity in delivering the SAP Upgrade programme as the Council will need to provide knowledge transfer to the new party and manage all the interaction and dependencies between the new 3rd party and the implementation team.
