Description
The ICB is directly awarding contracts to existing providers for a 12 month period commencing 1st April 2024. These are contract modifications and are to provide NHS Talking Therapies in Wirral, Warrington and Cheshire East, a national requirement and part of the NHS Long Term Plan and NHS Mental Health Implementation Plan. The services will provide a range of therapies for anxiety and depression based on emotional health concerns and working in conjunction with local partners and secondary care mental health services. Reasons for Direct Award are around the uncertainty in the National Health Mental Health plans post 23/24; a Direct Award now will give time for alignment and review of pathways and potential future procurement on a regional basis from March 2025. To provide contract modifications for NHS Talking Therapies in Wirral, Warrington and Cheshire East, a national requirement and part of the NHS Long Term Plan and NHS Mental Health Implementation Plan. Providing a range of therapies for anxiety and depression based emotional health concerns and working in conjunction with local partners and secondary care mental health services.

Legal Justification
Award of a contract without prior publication of a call for competition in the cases listed below: The procurement falls outside the scope of application of the regulations. Explanation: This Contract Award Notice is published under the Public Contract Regulations (PCR) 2015. It is for clinical services which are Light Touch Regime services for the purpose of the Public Contracts Regulations 2015 ('Regulations') as specified in Schedule 3 of the Regulations. Accordingly, the contracting authority is only bound by those parts of the Regulations detailed in Chapter 3 Particular Procurement Regimes Section 7. The contracting authority is not voluntarily following any other part of the Regulations. Justification of award of a contract without prior publication of a call for competition is justified in the cases listed below: The services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons Explanation: These contracts are contract modifications and are to be awarded under PCR 2015 Regulation 32 (1) (b) (ii), where the service can be supplied only by particular economic operators currently delivering the services, and no reasonable alternative exists, without considerable disruption to patient care. These contracts are therefore awarded on a 1 year to provide essential continuity for patients. The contract modification awards will ensure partnership working continues between the NHS Trust and the Independent Sector that will deliver crucial benefits, and minimise unnecessary disruption for patients at a time of great turmoil within the NHS, whilst longer term pathways are planned. This will also deliver essential financial efficiencies across the local health economy.
