Legal Justification
The supply and delivery of traffic signs and posts for the Department was originally contracted to two suppliers with items distributed across sixteen lots, with each supplier being award eight lots each. The Department terminated the contract with the other supplier in accordance with the Northern Ireland protocol for managing supplier poor performance. This action is very uncommon and was not foreseen by the contracting authority. It was necessary for the Department to modify this contract to ensure the availability of safety-critical road signage until a replacement contract is procured. The Department has commenced the development of a procurement competition to provide replacement contracts, which will be awarded by October 2024.

The total annual value of the contract containing lots 2, 3, 4, 11, 13, 14, 15 and 16 is £402,000. The total value of the contract is £2,010,000.
